1. Purpose & Scope

Upsender enforces a zero‑tolerance policy toward spam. By using our services, you agree to our Terms of Use and this Anti‑Spam Policy. We partner with ISPs, ESPs, and global anti‑spam organizations to combat spam, phishing, and deceptive practices that threaten deliverability and trust.

Consequences for violations:
Warning → Rate limiting → Temporary suspension → Permanent termination.

2. Performance Thresholds

Track record of your email activity must stay within these limits:

3. Core Metrics Explained

  • Bounces – Invalid/inactive recipient addresses.

  • Unsubscribes – Recipients who opt out from future emails.

  • Blocks – Emails prevented by server due to reputational or blacklist issues.

  • Spam Complaints – Recipients reporting your email as spam.

  • Spamtrap Hits – Sending to dead or hidden addresses.

  • Unjustified Abuse Complaints – Reports from recipients who never opted in.

4. Anti‑Spam Rules

4.1 — Maintain Acceptable Metrics

  • Clean your lists regularly; remove inactive contacts (no opens/clicks in 3–6 months).

  • Use honest subject lines. Avoid deceptive terms or “spammy” language.

4.2 — No External Lists

  • Purchased, rented, or scraped lists are strictly prohibited.

  • Only email explicitly opted-in recipients.

4.3 — Express Permission Required

  • Use unchecked opt-in boxes disclosing subscription purpose.

  • Double opt-in strongly recommended—required in many regions.

4.4 — Proof of Consent on Demand

In cases of abuse escalation, be ready to provide:

  • Consent date, time, and source (URL or offline form)

  • IP address or system-generated identifier

  • Opt-in method used (single/double)

  • Exact wording shown at signup

  • Customer relationship context (purchase history, etc.)

Failure to produce proof may result in immediate suspension.

4.5 — Unsubscribe Mechanism

  • Every marketing email must contain a visible unsubscribe link.

  • Process opt-outs immediately—do not send further marketing emails.

  • Transactional messages (invoices, receipts, reset emails) are exempt.

4.6 — Transparent Sender Identification

  • “From,” “Reply-To,” and all headers must clearly identify your domain and organization.

  • New domains (≤ 30 days old) must have proper DNS and legal pages.

  • For third-party senders, disclose “via [third-party]” in the header or body.

4.7 — Lawful & Legitimate Content Only

Do not send emails that:

  • Promote illegal acts, hate, violence, or defamation

  • Advertise restricted products: gambling, weapons, adult content, illegal substances

  • Push “get-rich-quick,” investment “advice,” forex, or penny stocks

  • Contain phishing, hacking, or malware links

Regulated industries (finance, healthcare, etc.) require a custom account and relevant documentation.

4.8 — Legal & Policy Compliance

  • Comply with all relevant laws (e.g., GDPR, CAN-SPAM, CASL).

  • Follow Upsender’s Terms, Privacy Policy, and SLAs.

  • Uphold standards—non-compliance may lead to delivery limits, review, or suspension.

5. Reporting and Enforcement

If you suspect abuse through Upsender:
